OFFICIAL RULES OF THE "COUCHE-TARD X BUDWEISER X BBQ QUÉBEC" CONTEST
IMPORTANT: PLEASE READ THESE OFFICIAL RULES (THE “OFFICIAL RULES”) BEFORE ENTERING THE “COUCHE-TARD X BUDWEISER X BBQ QUÉBEC” CONTEST (THE “CONTEST”). BY ENTERING THE CONTEST, THE ENTRANT MEETS ALL OF THE ELIGIBILITY REQUIREMENTS BELOW AND AGREES TO BE UNCONDITIONALLY BOUND BY THESE OFFICIAL RULES AND ALL DECISIONS OF LABATT BREWING COMPANY LIMITED (THE “CONTEST SPONSOR”) AND COUCHE-TARD (THE “CONTEST ADMINISTRATOR”).
ELIGIBILITY: To be eligible to participate, you must:
i. Be a legal resident of Quebec;
ii. Be of legal drinking age;
iii. Not be an employee, officer, director, contractor, agent or representative of the Contest Sponsor, Contest Administrator or any of their respective parent companies, subsidiaries, affiliates, agencies, or distributors.
iv. Not be an employee of the provincial liquor authorities, any liquor board, or any of their licensees, retailers or distributors (the “Provincial Liquor Authorities”); or
v. Not be a member of the immediate family (parent, spouse, sibling, child) of any of the above or domiciled with any of the abovementioned persons.
The Provincial Liquor Authorities are not connected to this Contest in any manner whatsoever and are not responsible for any matter related to this Contest.
To be eligible, participants must have Internet access and a valid email address on the date of their entry. In the event of a dispute as to the identity of a participant, the authorized account holder of the email address submitted at the time of entry will be deemed to be the participant. The person assigned to the email address by an online service provider, Internet access provider or other organization responsible for assigning the email address for the domain associated with the submitted email address is considered the authorized account holder. A participant may be required to provide the Contest Sponsor with proof that they are the authorized account holder of the email address associated with the winning entry.
CONTEST PERIOD: The Contest begins on or about May 27, 2025 at 8:01 a.m. and ends on June 23, 2025 at 11:59 p.m. (the “Contest Closing Date”), after which no further entries will be accepted (the “Contest Period”).
HOW TO ENTER: During the Contest Period, there are only two (2) ways to enter:
i. Participants can scan a QR code on the Contest Sponsor's promotional materials at participating locations, complete the Contest entry form in its entirety, and click the “Submit” button; or
ii. Participants can visit www.shopbeergear.ca/Couche-TardXBudXBBQQUEBEC (the “Contest Website”), complete the Contest entry form in its entirety, and then click the “Submit” button.
Limit of one (1) entry per person, per day (between 12:00:01 a.m. and 11:59:59 p.m. each calendar day during the Contest Period), regardless of the method of entry. Entries must be received by the Contest Closing Date. Entries received after the Contest Closing Date will be void. There are no other forms of entry submission than those mentioned above. Multiple participants cannot share the same email. Participants cannot enter with multiple emails or enter under multiple identities. Any participant who attempts to enter with multiple emails, accounts or under multiple identities will be disqualified and forfeit any prize won, at the sole discretion of the Contest Sponsor.
The Contest Sponsor assumes no responsibility for a potential participant's inability to successfully participate in the Contest for any reason. The Contest Sponsor is not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries, prize notification messages or any other information related to the Contest (collectively, the “Contest Information”), nor for Contest Information that was sent in error or that was produced or disseminated in a manner inconsistent with these Rules, all of which are void. Screenshots will not be accepted as proof of entry. All entries become the property of the Contest Sponsor.
VÉRIFICATION DE L’IDENTITÉ DES PERSONNES PARTICIPANTES : Le Commanditaire du Concours se réserve le droit d’exiger une preuve de conformité au présent Règlement officiel sous une forme acceptable pour le Commanditaire du Concours : (i) pour vérifier l’admissibilité d’une personne à participer à ce Concours; (ii) pour vérifier l’admissibilité ou la légitimité de tout renseignement relatif au Concours soumis ou reçu (ou prétendument soumis ou reçu) dans le cadre de ce Concours; et/ou (iii) pour toute autre raison jugée nécessaire par le Commanditaire du Concours dans le cadre de l’administration de ce dernier. Si cette preuve n’est pas fournie à l’entière satisfaction du Commanditaire du Concours dans le délai précisé, la personne participante risque d’être disqualifiée. Les données du serveur du Commanditaire du Concours seront les seules à déterminer le temps aux fins de ce Concours. Tous les renseignements demandés par le Commanditaire du Concours ou fournis à celui-ci dans le cadre du Concours doivent être véridiques, complets et exacts et ne doivent en aucun cas induire en erreur. Le Commanditaire du Concours se réserve le droit de disqualifier toute personne participante s’il estime qu’elle a fourni, à quelque moment que ce soit, des renseignements faux, incomplets, inexacts ou trompeurs. Toutes les décisions du Commanditaire du Concours sont définitives et ne peuvent faire l’objet d’un appel.
PRIX : Il y a un (1) prix à gagner parmi l’ensemble des 640 établissements Couche-Tard participants qui consiste en une (1) expérience barbecue à domicile d’une durée de 5 heures pour la personne gagnante et neuf (9) invité(e)s (une cour extérieure privée est nécessaire pour gagner le prix) (ci-après, le « Prix »). Le Prix comprend : la visite de deux (2) maîtres du barbecue à domicile, l’équipement barbecue, un (1) cours « barbecue 101 » ainsi que la nourriture. La valeur approximative au détail du Prix est de 5000 $ CA. La personne gagnante et ses invité(e)s doivent être âgé(e)s de 18 ans ou plus. Le Prix doit avoir lieu avant le 30 septembre 2025. L’alcool ne fait pas partie du Prix. La personne gagnante du Concours est responsable de toutes les dépenses et de tous les coûts qui ne sont pas mentionnés comme faisant partie du Prix.
Le Prix doit être accepté tel que décerné. Le Prix n’est pas transférable ni échangeable contre de l’argent, et ne peut pas être revendu. Aucune substitution, sauf par le Commanditaire du Concours, qui se réserve le droit de remplacer le Prix ou une partie du Prix par un prix de valeur égale ou supérieure. Toutes les décisions du Commanditaire du Concours relatives au Prix sont définitives et ne peuvent faire l’objet d’un appel. Le Commanditaire du Concours n’est pas responsable du Prix une fois qu’il a été attribué.
Le Commanditaire du Concours ne fait aucune déclaration et ne donne aucune garantie de quelque nature que ce soit concernant l’apparence, la sécurité ou le rendement d’un Prix.
CHANCES DE GAGNER : Les chances de gagner un Prix dépendent du nombre de participations admissibles reçues avant la Date de clôture du Concours.
ATTRIBUTION DES PRIX : Le Concours comprendra un (1) tirage au sort au cours duquel le Commanditaire du Concours ou son représentant désigné sélectionnera au hasard une (1) participation parmi toutes les participations admissibles reçues pendant la Période du Concours. Le tirage aura lieu le 24 juin à 12h00 (la « Date du tirage »). La personne participante sélectionnée sera avisée par le Commanditaire du Concours par courriel ou téléphone (selon les coordonnées fournies sur le formulaire de participation dans les trois (3) jours ouvrables suivant le tirage (l’« Avis »). Si la personne participante n’a pas répondu à l’Avis dans les trois (3) jours ouvrables suivant la réception de cet Avis, une autre personne participante peut, à la seule discrétion du Commanditaire du Concours, être sélectionnée par tirage au sort, auquel cas cette personne deviendra la personne participante sélectionnée et la personne participante précédemment sélectionnée sera alors disqualifiée et n’aura droit à aucun Prix.
Avant d’être déclarée gagnante, la personne participante sélectionnée doit répondre correctement, sans aide, à une question d’arithmétique réglementaire chronométrée et administrée par le Commanditaire du Concours. Avant qu’un Prix ne soit attribué, la personne sélectionnée peut être tenue de signer une déclaration de conformité au Règlement officiel et un formulaire d’exonération libérant le fournisseur du Prix, le Commanditaire du Concours, l’Administrateur du Concours ainsi que leurs sociétés affiliées, sociétés mères, filiales, conseiller(-ère)s professionnel(le)s, les Autorités provinciales en matière d’alcool et agences de publicité et de promotion respectives, et chacun de leurs administrateurs(-trices), dirigeant(e)s, employé(e)s, représentant(e)s et mandataires (collectivement, les « Parties exonérées ») de toute responsabilité découlant de, en vertu de ou à la suite de l’exécution du Concours, y compris, mais sans s’y limiter, la responsabilité découlant de l’acceptation et de l’utilisation du Prix tel qu’attribué, de l’administration du Concours et de la sélection d’une personne gagnante potentielle.
Si une personne gagnante potentielle d’un Prix ne répond pas à l’Avis dans le délai stipulé dans celui-ci, si elle est jugée inadmissible pour quelque raison que ce soit, si elle refuse d’accepter le Prix, si elle refuse de fournir un formulaire d’exonération signé, si elle répond incorrectement à la question d’arithmétique réglementaire obligatoire ou si elle manque de temps pour répondre correctement à la question d’arithmétique réglementaire obligatoire, elle sera disqualifiée et renoncera au Prix. Le Commanditaire du Concours peut alors, à sa seule et entière discrétion, sélectionner une autre personne participante admissible qui pourrait être disqualifiée de la même manière.
Le Commanditaire du Concours ne communiquera pas avec les personnes participantes, sauf avec les personnes participantes sélectionnées. Le Commanditaire du Concours n’est pas responsable du fait que, pour quelque raison que ce soit, une personne participante sélectionnée ne reçoive pas d’Avis ou que le Commanditaire du Concours ne reçoive pas la réponse d’une personne participante sélectionnée.
CHAQUE PERSONNE SÉLECTIONÉE EST CONSIDÉRÉE COMME UN(E) GAGNANT(E) POTENTIEL(LE) DU PRIX DANS L’ATTENTE DE LA VÉRIFICATION DE SON ADMISSIBILITÉ, DE LA FOURNITURE D’UNE RÉPONSE CORRECTE À UNE QUESTION D’ARITHMÉTIQUE RÉGLEMENTAIRE ET DE LA SIGNATURE D’UNE DÉCHARGE ET D’UNE INDEMNITÉ (LE CAS ÉCHÉANT). TOUTES LES PERSONNES GAGNANTES POTENTIELLES D’UN PRIX SONT SOUMISES À LA VÉRIFICATION DU COMMANDITAIRE DU CONCOURS, DONT LES DÉCISIONS SONT DÉFINITIVES ET CONTRAIGNANTES POUR TOUT CE QUI CONCERNE LE CONCOURS. LES PRIX NE SERONT PAS ATTRIBUÉS TANT QUE L’ADMISSIBILITÉ DE LA PERSONNE PARTICIPANTE N’AURA PAS ÉTÉ VÉRIFIÉE. LE COMMANDITAIRE DU CONCOURS N’ACCEPTERA PAS DE CAPTURES D’ÉCRAN OU D’AUTRES PREUVES À LA PLACE DE SON PROCESSUS DE VALIDATION.
EXONÉRATION : En participant au Concours et/ou en acceptant un Prix, chaque personne participante (i) accepte d’être liée par le présent Règlement officiel, ainsi que par toutes les conditions de participation; (ii) accepte que les décisions du Commanditaire du Concours soient définitives et sans appel; (iii) libère et décharge à jamais les Parties exonérées de toute action, cause d’action, poursuite, dette, réclamation, responsabilité, perte ou dépense et tout droit, compte, dommage, préjudice ou coût, y compris, mais sans s’y limiter, toute responsabilité pour toute blessure ou perte ou tout dommage de quelque nature que ce soit à la personne participante ou à toute autre personne, y compris les blessures corporelles, le décès ou les dommages matériels, découlant du Concours ou liés de quelque manière que ce soit, directement ou indirectement, au Concours, y compris, mais sans s’y limiter, la participation au Concours, toute violation du présent Règlement officiel, l’attribution, la réception, la possession, l’utilisation ou la mauvaise utilisation de tout prix du Concours (ou de toute partie de celui-ci), et tout voyage ou activité lié à la réception ou à l’utilisation d’un prix du Concours, ou la violation ou l’infraction de tout droit de propriété intellectuelle ou de tout droit à la publicité, à la personnalité ou à la vie privée, et accepte d’indemniser pleinement les Parties exonérées de toute réclamation de tiers liée à ce qui précède.
LIMITATION OF LIABILITY :: The Released Parties are not responsible for damages caused or allegedly caused by or arising out of: (i) any entry, prize or other correspondence or data that is lost, stolen, late, truncated, distorted, delayed, damaged or misdirected for any reason; (ii) any failure, interruption, technical malfunction or delay; (iii) any email, personal message, text message or other communication sent or received by the Contest Sponsor or any of its agents or designees, for any reason; (iv) any incorrect, untimely or inaccurate information, caused by the Contest Website, users, or by equipment or programming errors associated with or used in connection with the Contest; (v) any technical or human error that may occur in the processing of any Contest entry or registration; (vi) malfunctions of the Contest Website or any function of the Contest Website, whatever the cause; (vii) malfunction or damage to the telephone network, computer hardware, data, software, online systems, servers or access providers; (viii) any lost functionality due to the absence or deactivation of cookies; (ix) Internet traffic; (x) the security or privacy of information transmitted over computer networks; (xi) privacy breaches due to third party infiltration or any damage suffered by a participant or any other person due to such event; or (xii) technical, hardware or software failures of any kind, lost or unavailable network connections, unsuccessful, incomplete, truncated or delayed computer transmissions, including lost, misdirected or corrupted entries, damage caused by viruses, worms or Trojan horses, or any other damage that may limit a person's ability to participate in the Contest.
ERRORS: The Contest Sponsor is not responsible for typographical or other errors in the offer or administration of the Contest, including, but not limited to, advertising errors, the Official Rules, the Contest Website, the selection and announcement of a winner, or errors related to the distribution of a Prize. In no event shall the Contest Sponsor be liable for more Prizes than the number indicated in these Official Rules (at any level). If, due to a printing, production, online, Internet, computer or other error of any kind, a Prize notification incorrectly indicates the applicable Prize a participant may win, or mistakenly declares a participant to be a potential winner, that person may only receive the applicable Prize a participant may win as per the Contest Sponsor’s official data and records (as determined by the Contest Sponsor in its sole and absolute discretion).
RIGHT TO TERMINATE, MODIFY OR SUSPEND :: The Contest Sponsor may, at any time, in its sole discretion and without liability, terminate, modify or suspend the Contest in whole or in part, subject only to any approvals required by law, if fraud, technical failures, communication errors or other causes beyond the Contest Sponsor’s control corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of the Contest as contemplated by these Rules. Without limiting the generality of the foregoing, in the event of early termination of the Contest, notice will be posted on the Contest Website. In addition, in order to determine eligibility to win a Prize in the event of early termination of the Contest, all eligible entries received prior to the time of early termination will be considered valid and, for purposes of these Official Rules, the Contest Period will be deemed to have ended at the time of early termination. No waiver by the Contest Sponsor of any term hereof shall be deemed a continuing waiver or a waiver of any other term.
DISQUALIFICATIONS: If the Contest Sponsor discovers (through evidence or any information provided to it or obtained through its own means) that a person has attempted to: (i) exceed the limits or restrictions specified in these Official Rules; (ii) use multiple names, identities, email addresses, accounts and/or an automated or robotic system, a script, a macro or any other means or program to enter or participate in the Contest or disrupt its operation; (iii) enter the Contest more times than allowed; (iv) submit an entry or enter a unique code or PIN (if any) that has been forged, tampered with or altered in any way; (v) disrupt the Contest or participate in a fraudulent or misleading manner (including, but not limited to, cancelling, changing or modifying a transaction); or (vi) participate in the Contest in any other disruptive, abusive, fraudulent, misleading, unfair, unsportsmanlike or inconsistent manner with these Official Rules (as determined by the Contest Sponsor in its sole and absolute discretion); they may then be disqualified from the Contest, at the Contest Sponsor’s sole and absolute discretion. If a person is disqualified, they forfeit all rights to a Prize.
CAUTION: ANY DELIBERATE ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY ENTRY OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS; SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO DISQUALIFY THAT PARTICIPANT OR INDIVIDUAL AND SEEK DAMAGES OR PURSUE ANY OTHER REMEDY AGAINST THAT PARTICIPANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
PRIVACY POLICY: The Contest Sponsor respects your right to privacy. Personal information collected from participants will only be used by the Contest Sponsor to administer the Contest and fulfill Prize award conditions and, only if consent is given at the time of entry, to provide participants with information about upcoming promotions or events from the Contest Sponsor. For more information on how the Contest Sponsor collects, uses and discloses personal information, please refer to the Contest Sponsor's privacy policy at https://www.labatt.com/fr/privacy-policy.
APPLICABLE LAW: For consumers residing in Quebec, this Contest and the Official Rules are governed by Quebec law and all participants expressly agree that Quebec courts have exclusive jurisdiction for any dispute or litigation arising out of or related to this Contest, and agree to submit to the jurisdiction of Quebec courts.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid, unenforceable or illegal, these Rules shall remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
SUBJECT TO APPLICABLE LAWS: The Contest is subject to these complete Official Rules and all applicable federal, provincial and local laws and regulations. By participating in the Contest, you acknowledge that you have read the Official Rules and agree to abide by its terms and the decisions of the Contest Sponsor, which are final and binding on all matters relating to the Contest. Questions, comments or complaints regarding the Contest should be directed to the Contest Sponsor. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.
LANGUAGE DIFFERENCES: In the event of any discrepancy or inconsistency between the terms of these Official Rules and disclosures or other statements contained in any Contest-related information or materials, including, but not limited to, point of sale, television, print or online advertising, the terms of these Official Rules shall prevail, govern and control.
