OFFICIAL RULES OF THE "COUCH-TARD X ARCHIBALD X OUTDOOR KITCHEN" CONTEST
IMPORTANT : VEUILLEZ LIRE CE RÈGLEMENT OFFICIEL (LE « RÈGLEMENT OFFICIEL ») AVANT DE VOUS INSCRIRE AU CONCOURS « COUCHE-TARD X ARCHIBALD X CUISINE EXTÉRIEURE » (LE « CONCOURS »). EN S’INSCRIVANT AU CONCOURS, LA PERSONNE PARTICIPANTE SATISFAIT À TOUTES LES EXIGENCES D’ADMISSIBILITÉ CI-DESSOUS ET ACCEPTE D’ÊTRE LIÉE DE FAÇON INCONDITIONNELLE À CE RÈGLEMENT OFFICIEL ET À TOUTES LES DÉCISIONS DE LA BRASSERIE LABATT LIMITÉE (LE « COMMANDITAIRE DU CONCOURS ») ET COUCHE-TARD (L’« ADMINISTRATEUR DU CONCOURS »).
ADMISSIBILITÉ : Pour être admissible à participer, vous devez :
i. Être une résidente ou un résident légal du Québec;
ii. Avoir l’âge légal de consommer de l’alcool;
iii. Ne pas être un(e) employé(e), un(e) dirigeant(e), un(e) administrateur(-trice), un(e) sous-traitant(e), un(e) mandataire ou un(e) représentant(e) du Commanditaire du Concours, de l’Administrateur du Concours ou de l’une de ses sociétés mères, filiales, sociétés affiliées, agences ou entreprises de distribution respectives.
iv. Ne pas être un(e) employé(e) des autorités provinciales compétentes en matière d’alcool, d’une société ou d’une régie des alcools ou de ses titulaires de permis, détaillant(e)s ou distributeur(-trice)s (les « Autorités provinciales en matière d’alcool »); ou
v. Ne pas être un membre de la famille immédiate (parent, conjoint(e), frère, sœur, enfant) d’une de ces personnes ou domicilié(e) à la même adresse que l’une des personnes susmentionnées.
Les Autorités provinciales en matière d’alcool ne sont pas liées à ce Concours de quelque manière que ce soit et ne sont, de quelque manière que ce soit, aucunement responsables de toute question relative à ce Concours.
Pour être admissibles, les personnes participantes doivent avoir un accès à Internet ainsi qu’une adresse électronique valide à la date de leur participation. Si l’identité d’une personne participante est contestée, la ou le titulaire autorisé(e) du compte associé à l’adresse électronique soumise au moment de la participation sera considéré comme la personne participante. La personne assignée à l’adresse électronique par un fournisseur de services en ligne, un fournisseur d’accès Internet ou toute autre organisation responsable de l’attribution de l’adresse électronique pour le domaine associé à l’adresse électronique soumise est considérée comme la titulaire autorisée du compte. Une personne participante peut être tenue de fournir au Commanditaire du Concours la preuve qu’elle est la titulaire autorisée du compte de l’adresse électronique associée à la participation gagnante.
PÉRIODE DU CONCOURS : Le Concours débute le ou vers le 29 avril 2025 à 8h01 et se termine le 26 mai 2025 à 23h59 (la « Date de clôture du Concours »), après quoi aucune autre participation ne sera acceptée (la « Période du Concours »).
COMMENT PARTICIPER : Pendant la Période du Concours, il n’y a que deux (2) façons de participer :
i. les personnes participantes peuvent balayer un code QR figurant sur le matériel promotionnel du Commanditaire du Concours dans les établissements participants, remplir en entier le formulaire de participation au Concours et cliquer sur le bouton « Soumettre »; ou
ii. les personnes participantes peuvent se rendre sur www.shopbeergear.ca/Couche-TardXArchibaldXCuisineExterieure (le « Site Web du Concours »), remplir en entier le formulaire de participation au Concours, puis cliquer sur le bouton « Soumettre ».
Limite d’une (1) participation par personne, par jour (entre 0 h 00:01 et 23 h 59:59 chaque jour civil pendant la Période du Concours), quelle que soit la méthode de participation. Les participations doivent être reçues avant la Date de clôture du Concours. Les participations reçues après la Date de clôture du Concours seront nulles. Il n’existe aucune autre forme de soumission d’une participation que celles mentionnées ci-dessus. Plusieurs personnes participantes ne peuvent pas partager le même courriel. Les personnes participantes ne peuvent pas participer avec plusieurs courriels ni participer sous plusieurs identités. Toute personne participante qui tente de participer avec plusieurs courriels, comptes ou sous plusieurs identités sera disqualifiée et perdra tout prix gagné, à la seule discrétion du Commanditaire du Concours.
Le Commanditaire du Concours n’assume aucune responsabilité en cas d’incapacité d’une personne participante potentielle à participer avec succès au Concours pour quelque raison que ce soit. Le Commanditaire du Concours n’est pas responsable des participations tardives, perdues, mal adressées, en retard, incomplètes ou incompatibles, des messages de notification de prix ou de tout autre renseignement lié au Concours (collectivement, les « Renseignements relatifs au Concours »), ni des Renseignements relatifs au Concours qui ont été envoyés par erreur ou qui ont été produits ou diffusés d’une manière incompatible avec le présent Règlement, lesquels sont tous nuls. Les captures d’écran ne seront pas acceptées comme preuve de participation. Toutes les participations deviennent la propriété du Commanditaire du Concours.
VERIFICATION OF PARTICIPANTS' IDENTITY: The Contest Sponsor reserves the right to request proof of compliance with these Official Rules in a form acceptable to the Contest Sponsor: (i) to verify a person's eligibility to participate in this Contest; (ii) to verify the eligibility or legitimacy of any Contest information submitted or received (or allegedly submitted or received) in connection with this Contest; and/or (iii) for any other reason deemed necessary by the Contest Sponsor in connection with the administration of the Contest. If such proof is not provided to the Contest Sponsor's complete satisfaction within the specified timeframe, the participant may be disqualified. The Contest Sponsor's server data will be the sole determinant of time for the purposes of this Contest. All information requested by or provided to the Contest Sponsor in connection with the Contest must be truthful, complete, accurate, and must not be misleading in any way. The Contest Sponsor reserves the right to disqualify any participant if it believes that he/she has provided false, incomplete, inaccurate, or misleading information at any time. All decisions of the Contest Sponsor are final and not subject to appeal.
PRIZES: There is one (1) prize to be won among all participating establishments, consisting of an Archibald outdoor kitchen setup. The approximate retail value of the Prize is CAD $10,000 (hereinafter, the "Prize"). The Prize will be awarded to the winner in the form of one (1) CAD $10,000 gift card, which must be used at a participating Tanguay establishment within one year of the Contest Closing Date. Alcohol is not part of the Prize.
Contest winners are responsible for all expenses and costs not mentioned as part of the Prize. Once the winner is confirmed, the Prize will be shipped to the address provided by the selected participant on the liability release form or declaration of compliance with the Official Rules (if applicable). The Contest Sponsor will not deliver the Prize to a post office box.
The Prize must be accepted as awarded. The Prize is not transferable or exchangeable for cash, and cannot be resold. No substitution, except by the Contest Sponsor, who reserves the right to substitute the Prize or any part of the Prize with a prize of equal or greater value. All decisions of the Contest Sponsor regarding the Prize are final and not subject to appeal. The Contest Sponsor is not responsible for the Prize once it has been shipped.
The Contest Sponsor makes no representations or warranties of any kind regarding the appearance, safety, or performance of any Prize.
ODDS OF WINNING: The odds of winning a Prize depend on the number of eligible entries received before the Contest Closing Date.
PRIZE AWARDING: The Contest will include one (1) random draw during which the Contest Sponsor or its designated representative will randomly select one (1) entry from all eligible entries received during the Contest Period. The draw will take place on May 27 at 12:00 PM (the "Draw Date") in Montreal. The selected participant will be notified by the Contest Sponsor via email or phone (using the contact details provided on the entry form) within three (3) business days following the draw (the "Notification"). If the participant has not responded to the Notification within three (3) business days of receiving it, another participant may, at the sole discretion of the Contest Sponsor, be selected by random draw, in which case this person will become the selected participant and the previously selected participant will then be disqualified and will not be entitled to any Prize.
Before being declared a winner, the selected participant must correctly answer, without assistance, a timed mathematical skill-testing question administered by the Contest Sponsor. Before a Prize is awarded, the selected person may be required to sign a declaration of compliance with the Official Rules and a release form releasing the Prize provider, the Contest Sponsor, the Contest Administrator, as well as their respective affiliates, parent companies, subsidiaries, professional advisors, provincial liquor authorities, and advertising and promotional agencies, and each of their respective directors, officers, employees, representatives, and agents (collectively, the "Released Parties") from any liability arising from, under, or as a result of the execution of the Contest, including, but not limited to, liability arising from the acceptance and use of the Prize as awarded, the administration of the Contest, and the selection of a potential winner.
If a potential Prize winner does not respond to the Notification within the timeframe stipulated therein, is found to be ineligible for any reason, refuses to accept the Prize, refuses to provide a signed release form, incorrectly answers the mandatory mathematical skill-testing question, or runs out of time to correctly answer the mandatory mathematical skill-testing question, they will be disqualified and forfeit the Prize. The Contest Sponsor may then, at its sole and absolute discretion, select another eligible participant who may be disqualified in the same manner.
The Contest Sponsor will not contact participants, except for selected participants. The Contest Sponsor is not responsible for a selected participant not receiving a Notification for any reason, or for the Contest Sponsor not receiving a response from a selected participant.
EACH SELECTED PERSON IS CONSIDERED A POTENTIAL PRIZE WINNER PENDING VERIFICATION OF ELIGIBILITY, THE PROVISION OF A CORRECT ANSWER TO A MATHEMATICAL SKILL-TESTING QUESTION, AND THE SIGNATURE OF A RELEASE AND INDEMNITY (IF APPLICABLE). ALL POTENTIAL PRIZE WINNERS ARE SUBJECT TO VERIFICATION BY THE CONTEST SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATING TO THE CONTEST. PRIZES WILL NOT BE AWARDED UNTIL THE PARTICIPANT'S ELIGIBILITY HAS BEEN VERIFIED. THE CONTEST SPONSOR WILL NOT ACCEPT SCREENSHOTS OR OTHER EVIDENCE IN LIEU OF ITS VALIDATION PROCESS.
RELEASE: By participating in the Contest and/or accepting a Prize, each participant (i) agrees to be bound by these Official Rules, as well as all terms and conditions of participation; (ii) agrees that the decisions of the Contest Sponsor are final and binding; (iii) forever releases and discharges the Released Parties from any and all actions, causes of action, suits, debts, claims, liabilities, losses or expenses and any right, account, damage, injury or cost, including, but not limited to, any liability for any injury or loss or damage of any kind to the participant or any other person, including personal injury, death or property damage, arising from or in any way related, directly or indirectly, to the Contest, including, but not limited to, participation in the Contest, any violation of these Official Rules, the awarding, receipt, possession, use or misuse of any Contest prize (or any portion thereof), and any travel or activity related to the receipt or use of a Contest prize, or the violation or infringement of any intellectual property rights or any right of publicity, personality or privacy, and agrees to fully indemnify the Released Parties from any third-party claims related to the foregoing.
LIMITATION OF LIABILITY: The Released Parties are not responsible for any damages caused or alleged to be caused by or resulting from: (i) any lost, stolen, late, truncated, distorted, delayed, damaged or misdirected Entry, Prize, or other correspondence or data for any reason; (ii) any failure, interruption, technical malfunction or delay; (iii) any email, personal message, text message, or other communication sent or received by the Contest Sponsor or any of its agents or designees, for any reason; (iv) for any incorrect, untimely, or inaccurate information, whether caused by the Contest Website, users, or by equipment or programming errors associated with or utilized in the Contest; (v) any technical or human error that may occur in the processing of any Entry or Contest registration; (vi) the operation of the Contest Website or any Contest Website feature, regardless of cause; (vii) malfunction, or damage caused to any telephone network, computer equipment, data, software, online systems, servers, or access providers; (viii) any lost functionality due to the absence or disablement of cookies; (ix) Internet traffic; (x) the security or privacy of information transmitted via computer networks; (xi) breaches of privacy due to third-party infiltration, or any harm suffered by a participant or any other person due to such event; or (xii) technical, hardware, or software failures of any kind, lost or unavailable network connections, unsuccessful, incomplete, truncated, or delayed computer transmissions, including lost, misdirected, or corrupted entries, damage caused by viruses, worms, or Trojan horses, or any other damage that may limit a person’s ability to participate in the Contest.
ERRORS: The Contest Sponsor is not responsible for any typographical or other error in the offer or administration of the Contest, including, but not limited to, errors in advertising, the Official Rules, the Contest Website, the selection and announcement of a winner, or errors in the distribution of a Prize. In no event will the Contest Sponsor be liable for more than the number of Prizes stated in these Official Rules (at any level). If, due to printing, production, online, Internet, computer, or other error of any kind, a Prize notification erroneously indicates the applicable Prize a participant is able to win, or erroneously states that a participant is a potential winner, that participant will only be able to receive the applicable Prize a participant is able to win as per the Contest Sponsor’s official data and records (as determined by the Contest Sponsor in its sole and absolute discretion).
RIGHT TO TERMINATE, MODIFY OR SUSPEND : The Contest Sponsor may, at any time and in its sole discretion and without liability, terminate, modify or suspend the Contest in whole or in part, subject only to any approvals required by law, if fraud, technical failures, communication errors or other causes beyond the control of the Contest Sponsor corrupt the administration, integrity, or security of the Contest or if any other factor interferes with the conduct of the Contest as set forth in these Rules. Without limiting the generality of the foregoing, in the event of an early termination of the Contest, a notice to that effect will be posted on the Contest Website. In addition, in order to determine eligibility to win a Prize in the event of an early termination of the Contest, all eligible entries received prior to the time of early termination will be considered valid and, for the purposes of these Official Rules, the Contest Period will be deemed to have ended at the time of early termination. No waiver by the Contest Sponsor of the application of any condition herein will be deemed a continued waiver or waiver of any other condition.
DISQUALIFICATIONS: If the Contest Sponsor discovers (through evidence or information provided to it or obtained through its own means) that a person has attempted to: (i) exceed the limits or restrictions specified in these Official Rules; (ii) use multiple names, identities, email addresses, accounts, and/or automated or robotic systems, scripts, macros, or other means or programs to enter or participate in the Contest or disrupt its operation; (iii) enter the Contest more times than allowed; (iv) submit an entry or enter a unique code or PIN (if applicable) that has been falsified, tampered with, or altered in any way; (v) disrupt the Contest or participate in it in a fraudulent or deceptive manner (including, but not limited to, canceling, changing, or modifying a transaction); or (vi) participate in the Contest in any other disruptive, abusive, fraudulent, deceptive, unfair, unsportsmanlike, or inconsistent manner with these Official Rules (as determined by the Contest Sponsor in its sole and absolute discretion); they may then be disqualified from the Contest, at the sole and absolute discretion of the Contest Sponsor. If a person is disqualified, they forfeit all rights to a Prize.
WARNING: ANY DELIBERATE ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DAMAGE OR INTERFERE WITH ANY ENTRY OR TO COMPROMISE THE LEGITIMATE CONDUCT OF THE CONTEST CONSTITUTES A VIOLATION OF CRIMINAL AND CIVIL LAWS; SHOULD SUCH AN ATTEMPT BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO DISQUALIFY THAT PARTICIPANT OR INDIVIDUAL AND SEEK DAMAGES OR PURSUE ANY OTHER REMEDY AGAINST THAT PARTICIPANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
PRIVACY POLICY: The Contest Sponsor respects your right to privacy. Personal information collected from participants will only be used by the Contest Sponsor to administer the Contest and fulfill the Prize award conditions and, only if consent is given at the time of entry, to provide participants with information about upcoming promotions or events of the Contest Sponsor. For more information on how the Contest Sponsor collects, uses, and discloses personal information, please consult the Contest Sponsor’s privacy policy at https://www.labatt.com/fr/privacy-policy.
GOVERNING LAW: For consumers residing in Quebec, this Contest and the Official Rules are governed by Quebec legislation and all participants expressly agree that the courts of Quebec have exclusive jurisdiction for any dispute or litigation arising out of or relating to this Contest, and agree to submit to the jurisdiction of the Quebec courts.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid, unenforceable or illegal, these Rules shall remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
SUBJECT TO APPLICABLE LAWS: The Contest is subject to these complete Official Rules and all applicable federal, provincial, and local laws and regulations. By participating in the Contest, you acknowledge that you have read the Official Rules and agree to abide by their terms and the decisions of the Contest Sponsor, which are final and binding on all matters relating to the Contest. Questions, comments, or complaints regarding the Contest should be addressed to the Contest Sponsor. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.
LANGUAGE DISCREPANCIES: In the event of any discrepancy or inconsistency between the terms of these Official Rules and disclosures or other statements contained in any Contest-related information or materials, including, but not limited to, point-of-sale, television, print, or online advertising, the terms of these Official Rules shall prevail, govern, and control.
