“Bud Light Country – Tower Speaker 2024” Contest (the “Contest”)
OFFICIAL CONTEST RULES
IMPORTANT: PLEASE READ THESE OFFICIAL RULES (THE “RULES”) BEFORE ENTERING THE “BUD LIGHT COUNTRY – TOWER SPEAKER” CONTEST (THE “CONTEST”). BY ENTERING THE CONTEST, THE ENTRANT MEETS ALL ELIGIBILITY REQUIREMENTS AND AGREES TO BE UNCONDITIONALLY BOUND BY THESE OFFICIAL RULES AND ALL DECISIONS OF LABATT BREWERIES OF CANADA (THE “CONTEST SPONSOR”).
ELIGIBILITY
The Contest is open to all residents of Newfoundland and Labrador, New Brunswick, or British Columbia who are of legal drinking age, who are not employees, contractors, agents, or representatives of the Contest Sponsor, or its affiliates, agencies or distribution companies, and who are not employees of the provincial liquor authorities, any liquor board, or its licensees, retailers or distributors (the “Provincial Liquor Authorities”), prize suppliers, the Contest judge (collectively, the “Contest Parties”) or a member of the immediate family (parent, spouse, sibling, child) of or domiciled with any of the above. The Provincial Liquor Authorities are not connected with this Contest in any manner whatsoever and are not liable in any way whatsoever with regard to any matter which relates to this Contest.
CONTEST PERIOD
The Contest begins on or about March 1, 2024 at approximately 12:00 PM (noon) and ends on April 30, 2024 at 11:59 PM (the “Contest Closing Date”). As set out below in these Official Rules, the start and end time of the Contest period for any given participating location is determined by the time zone corresponding to the location of the participating location in question.
HOW TO ENTER
To enter, legibly and fully complete an entry ballot (each, an “Entry”), and submit it by depositing it into the ballot box by the Contest Closing Date. Entries received after the Contest Closing Date will be void.
To be eligible to win, entrants must fully complete the contest entry ballot, including providing the correct answer to the mathematical skill-testing question found on the entry ballot, and must comply with these Official Contest Rules.
Limit of one (1) Entry per person per day during the Contest Period. Limit of one (1) Prize per person/household. Any entrant who attempts to enter with multiple entry ballots under multiple identities will be disqualified and forfeit any prize won, in the Contest Sponsor’s sole discretion.
PRIZE
There is one (1) prize available to be won at each participating location (there are one hundred thirty [130] total prizes available to be won across all participating locations). Each prize consists of one (1) tower speaker (hereinafter the “Prize”). The approximate retail value of each Prize is $500.00 CAD. Alcohol is not part of the Prize.
The odds of winning the Prize depend on the total number of eligible entries received during the Contest Period at each participating location.
The Prize must be accepted as awarded. The Prize is non-transferable and not exchangeable for cash. No Prize substitutions will be permitted, except by the Contest Sponsor, who reserves the right to substitute a prize or any portion of a prize with a prize of equal or greater value. All decisions of the Contest Sponsor are final and not subject to appeal. The Prize may be forfeited if the selected winner fails to claim it at the location where they entered within two (2) weeks of being declared a winner. The Contest Sponsor is not responsible for the Prize once it has been picked up.
The Contest Sponsor makes no representations or warranties whatsoever in respect of the appearance, safety, or performance of any Prize.
If the number of eligible entries received is less than the number of Prizes to be awarded, only eligible entries received will be drawn, and remaining prizes will not be awarded.
AWARDING OF PRIZES
On May 2, 2024, at 12:00 PM (the “Draw Date”), one (1) Prize will be drawn at each participating location, from all eligible entries received during the Contest Period. The selected entrant will be notified by telephone by the participating location or its designated agent within three (3) business days of the Draw Date. If the selected entrant does not respond to the Contest Sponsor or its designated agent within the prescribed timeframe, another entrant may, at the sole discretion of the Contest Sponsor, be selected by way of a random draw, in which case the prior selected entrant will be disqualified and will have no claim to any prize.
Before the Prize is awarded, the winner will be required to sign a declaration of compliance with the Official Rules and release forms releasing the Contest Sponsor and their affiliates, parent companies, subsidiaries, professional advisors, the Provincial Liquor Authorities and advertising and promotional agencies (collectively, the “Released Parties”) from any liability arising out of, under, or in connection with the Contest, including, but not limited to, liability arising from the acceptance and use of prizes as awarded, the administration of the Contest, and the selection of a potential winner.
If a potential Prize winner fails to respond to the notification within the timeframe stipulated in it, is found to be ineligible for any reason, declines to accept the Prize, incorrectly answers the mandatory mathematical skill-testing question or runs out of time to correctly answer the mandatory mathematical skill-testing question, they will be disqualified and will forfeit the Prize. The Contest Sponsor may then, in its sole and absolute discretion, select another eligible entrant who may be disqualified in the same manner. The Contest Sponsor will not be responsible for unsuccessful attempts to notify any potential winner.
Prizes must be accepted as awarded. Prizes are not transferable and are not exchangeable for cash. No Prize substitutions will be permitted, except by the Contest Sponsor, who reserves the right to substitute any of the prizes with a prize of equal or greater value. All decisions of the Contest Sponsor are final and not subject to appeal. The Prize may be forfeited if the winner fails to claim it at the location where the ballot was submitted.
The Contest Sponsor will not contact entrants, except for selected entrants. The Contest Sponsor is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for the Contest Sponsor to receive a selected entrant’s response.
RELEASE
By entering the contest and submitting an entry, each entrant (i) agrees to be bound by these Official Rules, as well as by all the conditions of participation; (ii) agrees that the decisions of the Contest Sponsor are final and binding; (iii) forever releases and discharges the Released Parties from any action, cause of action, suit, debt, claim, liability, loss or expense and any right, account, damage, injury or cost, including, without limitation, any liability for any injury or loss or any damage of any kind whatsoever to the entrant or any other person, including personal injury, death or property damage, arising from or in any way related, directly or indirectly, to the contest, including, without limitation, the entrant’s participation in the contest, any breach of these Official Rules, the awarding, receipt, possession, use or misuse of any contest prize (or any portion thereof), and any travel or activity related to the receipt or use of a contest prize, or the violation or infringement of any intellectual property right or any right of publicity, personality or privacy, and agrees to fully indemnify the Released Parties from any third-party claims related to the foregoing.
LIMITATION OF LIABILITY
The Released Parties are not responsible for any damage caused or allegedly caused by or resulting from: (i) any entry, prize or other correspondence or data that is lost, stolen, late, truncated, distorted, delayed, damaged or misdirected for any reason; (ii) any failure, interruption, technical malfunction or delay; (iii) any email, text message or other communication sent or received by the Contest Sponsor or any of its agents or designees, for any reason; for any incorrect, untimely or inaccurate information, caused by a website, users or by equipment or programming errors associated with or used in connection with the contest; (iv) any technical or human error that may occur in the processing of any entry or registration for the contest; (v) for malfunctions of any website or any feature of the website, whatever the cause; (vi) malfunction or damage to the network or telephone line, computer hardware, data, software, online systems, servers or access providers; (vii) any functionality lost due to lack of cookies; (viii) Internet traffic; (ix) the security or privacy of information transmitted over computer networks; (x) privacy breaches due to infiltration by third-party "hackers" or any damage suffered by an entrant or any other person due to such an event; or (xi) technical, hardware or software failures of any kind, lost or unavailable network connections, unsuccessful, incomplete, truncated or delayed computer transmissions, including lost, misdirected or corrupt entries, damage caused by viruses, worms or Trojan horses or any other damage that may limit a person's ability to participate in the contest.
ERRORS The Contest Sponsor is not responsible for typographical or other errors in the offer or administration of the contest, including, but not limited to, errors in advertising, the official rules, the selection and announcement of a winner, or the distribution of any prize. RIGHT TO TERMINATE, MODIFY OR SUSPENDThe Contest Sponsor may at any time, in its sole discretion and without liability, terminate, modify or suspend the contest in whole or in part, subject only to approvals required by law, if fraud, technical failures, communication errors or other causes beyond the Contest Sponsor's control corrupt the administration, integrity or security of the contest or if any other factor affects the conduct of the contest as provided in these rules. Without limiting the generality of the foregoing, in the event of early termination of the contest, notice will be posted to that effect on the contest website. In addition, in order to determine eligibility to win a prize in the event of early termination of the contest, all eligible entries received prior to the time of early termination will be considered valid and, for the purposes of these rules, the contest period will be deemed to have ended at the time of early termination. The Contest Sponsor reserves the right, at any time, in its sole discretion, to correct any error, including, without limitation, any typographical, printing, computer programming or operator error. No waiver by the Contest Sponsor of any term herein shall be deemed a continuing waiver or a waiver of any other condition.DISQUALIFICATIONSThe Contest Sponsor reserves the right, in its sole discretion, to disqualify any person who (i) tampers with the entry process or the operation of the contest; (ii) acts in violation of the official rules; (iii) has submitted an entry not conforming to these rules; or (iv) acts in an unfair or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY DELIBERATE ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO MODIFY OR DAMAGE ANY ENTRY OR TO COMPROMISE THE LEGITIMATE OPERATION OF THE CONTEST CONSTITUTES A VIOLATION OF CRIMINAL AND CIVIL LAWS; SHOULD SUCH AN ATTEMPT OCCUR, THE CONTEST SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH ENTRANT OR INDIVIDUAL AND TO SEEK DAMAGES OR TAKE ANY OTHER REMEDY AGAINST SUCH ENTRANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.VOID IF MODIFIEDEntry forms are void if illegible, altered or tampered with. All contest entry forms become the property of the Contest Sponsor and none will be returned. The Contest Sponsor is not responsible for lost or late entry forms, nor for their falsification or ineligibility. All decisions of the Contest Sponsor are final.PRIVACY POLICY The Contest Sponsor respects your right to privacy. Personal information collected from entrants will only be used by the Contest Sponsor to administer the contest and fulfill prize award conditions and, only if consent is given at the time of entry, to provide entrants with information on upcoming promotions or events of the Contest Sponsor. For more information on how the Contest Sponsor collects, uses and discloses personal information, please consult the Contest Sponsor's privacy policy at www.shopbeergear.ca/etwhaut-parleurAPPLICABLE LAWSubject to applicable law and these official rules, this contest and the official rules are governed by the law of Ontario and all entrants expressly agree that the courts of Ontario have exclusive jurisdiction for any dispute or litigation arising from or relating to this contest, and agree to submit to the jurisdiction of the courts of Ontario. The venue of any dispute or litigation will be Toronto, Ontario. The invalidity or unenforceability of any clause in these rules does not compromise the validity or enforceability of any other clause. In the event that a clause is deemed invalid, unenforceable or illegal, these rules will remain in effect and will be interpreted in accordance with their terms as if the invalid or illegal clause was not included.SUBJECT TO APPLICABLE LAWS The contest is subject to these complete official rules and all applicable federal, provincial and local laws and regulations. By participating in the contest, you acknowledge that you have read the official rules and agree to comply with their terms and the decisions of the Contest Sponsor, which are final and binding on all matters relating to the contest. Questions, comments or complaints regarding the contest should be addressed to the Contest Sponsor. All federal, provincial and local laws and regulations apply. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.LANGUAGE DIFFERENCES In the event of any discrepancy or inconsistency between the terms of these Official Rules and the disclosures or other statements contained in any contest-related materials, including, but not limited to, point-of-sale, television, print or online advertising, the terms of these Official Rules shall prevail, govern and control.
