OFFICIAL RULES OF THE “PARKLAND X BUD BBQ NAPOLEON” CONTEST

IMPORTANT: PLEASE READ THESE OFFICIAL RULES (THE “OFFICIAL RULES”) BEFORE ENTERING THE “PARKLAND X BUD BBQ NAPOLEON” CONTEST (THE “CONTEST”). BY ENTERING THE CONTEST, THE PARTICIPANT MEETS ALL THE ELIGIBILITY REQUIREMENTS BELOW AND AGREES TO BE UNCONDITIONALLY BOUND BY THESE OFFICIAL RULES AND ALL DECISIONS OF LABATT BREWERIES LIMITED (THE “CONTEST SPONSOR”) AND PARKLAND (THE “CONTEST ADMINISTRATOR”).

 

 

ELIGIBILITY : To be eligible to participate, you must:

 

  1. Be a legal resident of Quebec;
  2. Be of legal drinking age;
  3. Not be an employee, officer, director, contractor, agent, or representative of the Contest Sponsor, the Contest Administrator, or any of their parent companies, subsidiaries, affiliates, agencies, or respective distribution companies;
  4. Not be an employee of the provincial alcohol authorities, a liquor board or corporation, or their licensees, retailers, or distributors (the “Provincial Alcohol Authorities”); or
  5. Not be an immediate family member (parent, spouse, sibling, child) of any of these persons or reside at the same address as any of the aforementioned persons.

The Provincial Alcohol Authorities are not associated with this Contest in any way and are not responsible for any matters related to this Contest.

To be eligible, participants must have Internet access and a valid email address at the time of entry. If a participant’s identity is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed the participant. The person assigned to the email address by an online service provider, Internet access provider, or any other organization responsible for assigning email addresses for the domain associated with the submitted email address is considered the authorized account holder. A participant may be required to provide the Contest Sponsor with proof that they are the authorized account holder of the email address associated with the winning entry.

 

CONTEST PERIOD: The Contest begins on or about July 16, 2025, at 8:01 a.m. and ends on September 16, 2025, at 11:59 p.m. (the “Contest Closing Date”), after which no further entries will be accepted (the “Contest Period”).

 

HOW TO ENTER : During the Contest Period, there are only two (2) ways to enter:

 

  1. Participants may scan a QR code found on the Contest Sponsor’s promotional material in participating locations, fully complete the contest entry form, and click the “Submit” button; or
  2. Participants may visit https://www.shopbeergear.ca/BudweiserBBQNapoleonParkland (the “Contest Website”), fully complete the contest entry form, and click the “Submit” button.

 

Limit of one (1) entry per person, per day (between 12:00:01 a.m. and 11:59:59 p.m. each calendar day during the Contest Period), regardless of the method of entry. Entries must be received before the Contest Closing Date. Entries received after the Contest Closing Date will be void. No other forms of entry submission are accepted other than those mentioned above. Multiple participants may not share the same email. Participants may not enter with multiple emails or participate under multiple identities. Any participant who attempts to enter with multiple emails, accounts, or under multiple identities will be disqualified and will forfeit any prize won, at the sole discretion of the Contest Sponsor.

 

The Contest Sponsor assumes no responsibility for a potential participant’s inability to successfully enter the Contest for any reason. The Contest Sponsor is not responsible for late, lost, misdirected, delayed, incomplete, or incompatible entries, prize notification messages, or any other contest-related information (collectively, “Contest Information”), nor for Contest Information sent in error or produced or distributed in a manner inconsistent with these Rules, all of which are void. Screenshots will not be accepted as proof of entry. All entries become the property of the Contest Sponsor.

 

VERIFICATION OF PARTICIPANT IDENTITY: The Contest Sponsor reserves the right to require proof of compliance with these Official Rules in a form acceptable to the Contest Sponsor: (i) to verify a person’s eligibility to participate in this Contest; (ii) to verify the eligibility or legitimacy of any Contest Information submitted or received (or purportedly submitted or received) in connection with this Contest; and/or (iii) for any other reason deemed necessary by the Contest Sponsor in the administration of the Contest. If such proof is not provided to the complete satisfaction of the Contest Sponsor within the specified time, the participant may be disqualified. The Contest Sponsor’s server data will be the sole determinant of time for the purposes of this Contest. All information requested by or provided to the Contest Sponsor in connection with the Contest must be truthful, complete, and accurate and must not mislead in any way. The Contest Sponsor reserves the right to disqualify any participant if it is determined that they have provided false, incomplete, inaccurate, or misleading information at any time. All decisions of the Contest Sponsor are final and not subject to appeal.

 

PRIZES: There are 40 prizes to be won among all 157 participating Marché Express locations, each consisting of one (1) Napoleon Rogue XT425 BBQ (hereinafter, the “Prize”). The approximate retail value of the Prize is $1,100 CAD. Alcohol is not included in the Prize. The Contest winner is responsible for all expenses and costs not mentioned as part of the Prize.

The Prize must be accepted as awarded. The Prize is not transferable or exchangeable for cash and may not be resold. No substitution, except by the Contest Sponsor, who reserves the right to substitute the Prize or part of the Prize with a prize of equal or greater value. All decisions of the Contest Sponsor regarding the Prize are final and not subject to appeal. The Contest Sponsor is not responsible for the Prize once it has been shipped.

The Contest Sponsor makes no representations or warranties of any kind regarding the appearance, safety, or performance of a Prize.

 

ODDS OF WINNING

The odds of winning a Prize depend on the number of eligible entries received before the Contest Closing Date.

 

PRIZE AWARDING

The Contest will include one (1) random draw in which the Contest Sponsor or its designated representative will randomly select 40 entries from all eligible entries received during the Contest Period. The draw will take place on September 17, 2025, at 12:00 p.m. (“Draw Date”) in Montreal. The selected participant will be notified by the Contest Sponsor by email or phone (using the contact information provided on the entry form) within three (3) business days following the draw (“Notice”). If the selected participant does not respond to the Notice within three (3) business days of receiving it, another participant may, at the sole discretion of the Contest Sponsor, be selected by random draw, in which case that person will become the selected participant and the previously selected participant will be disqualified and have no right to any Prize.

 

Before being declared a winner, the selected participant must correctly answer, unaided, a time-limited mathematical skill-testing question administered by the Contest Sponsor. Before a Prize is awarded, the selected person may be required to sign a declaration of compliance with the Official Rules and a release form releasing the Prize supplier, the Contest Sponsor, the Contest Administrator, their affiliates, parent companies, subsidiaries, professional advisors, the Provincial Alcohol Authorities, and their respective advertising and promotion agencies, and each of their directors, officers, employees, representatives, and agents (collectively, the “Released Parties”) from any liability arising from, under, or as a result of the execution of the Contest, including, but not limited to, liability arising from the acceptance and use of the Prize as awarded, the administration of the Contest, and the selection of a potential winner.

If a potential Prize winner does not respond to the Notice within the stipulated time, is deemed ineligible for any reason, refuses to accept the Prize, refuses to provide a signed release form, answers the required skill-testing question incorrectly, or fails to answer the skill-testing question within the allotted time, they will be disqualified and forfeit the Prize. The Contest Sponsor may then, at its sole and absolute discretion, select another eligible participant, who may be disqualified in the same manner.

The Contest Sponsor will not communicate with participants except with selected participants. The Contest Sponsor is not responsible if, for any reason, a selected participant does not receive the Notice or if the Contest Sponsor does not receive a response from a selected participant.

 

EACH SELECTED PERSON IS CONSIDERED A POTENTIAL PRIZE WINNER PENDING VERIFICATION OF ELIGIBILITY, CORRECT ANSWER TO A SKILL-TESTING QUESTION, AND SIGNATURE OF A RELEASE AND INDEMNITY (IF APPLICABLE). ALL POTENTIAL PRIZE WINNERS ARE SUBJECT TO VERIFICATION BY THE CONTEST SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATING TO THE CONTEST. PRIZES WILL NOT BE AWARDED UNTIL THE PARTICIPANT’S ELIGIBILITY HAS BEEN VERIFIED. THE CONTEST SPONSOR WILL NOT ACCEPT SCREENSHOTS OR OTHER EVIDENCE IN LIEU OF ITS VALIDATION PROCESS.

 

RELEASE : By participating in the Contest and/or accepting a Prize, each participant (i) agrees to be bound by these Official Rules and all conditions of participation; (ii) agrees that the decisions of the Contest Sponsor are final and binding; (iii) forever releases and discharges the Released Parties from any action, cause of action, lawsuit, debt, claim, liability, loss or expense and any right, account, damage, injury, or cost, including, but not limited to, any liability for any injury, loss, or damage of any kind to the participant or any other person, including bodily injury, death, or property damage, arising from or in any way related, directly or indirectly, to the Contest, including, but not limited to, participation in the Contest, any violation of these Official Rules, the awarding, receipt, possession, use or misuse of any Contest prize (or any part thereof), and any travel or activity related to the receipt or use of a Contest prize, or the violation or infringement of any intellectual property right or any right of publicity, personality, or privacy, and agrees to fully indemnify the Released Parties from any third-party claim related to the foregoing.

 

LIMITATION OF LIABILITY : The Released Parties are not responsible for damages caused or allegedly caused by or resulting from: (i) any entry, prize, or other correspondence or data lost, stolen, late, truncated, distorted, delayed, damaged, or misdirected for any reason; (ii) any failure, interruption, technical malfunction, or delay; (iii) any email, personal message, text message, or other communication sent or received by the Contest Sponsor or any of its agents or designees, for any reason; (iv) any incorrect, untimely, or inaccurate information, caused by the Contest Website, users, or equipment or programming errors associated with or used in the Contest; (v) any technical or human error that may occur in the processing of any entry or registration for the Contest; (vi) malfunctions of the Contest Website or any function of the Contest Website, for any reason; (vii) malfunction or damage to telephone networks, computer hardware, data, software, online systems, servers, or access providers; (viii) any lost functionality due to the absence or deactivation of cookies; (ix) Internet traffic; (x) the security or confidentiality of information transmitted through computer networks; (xi) privacy breaches due to third-party intrusion or any damage suffered by a participant or any other person as a result of such an event; or (xii) technical, hardware, or software failures of any kind, lost or unavailable network connections, unsuccessful, incomplete, truncated, or delayed computer transmissions, including lost, misdirected, or corrupted entries, damage caused by viruses, worms, or Trojan horses, or any other damage that may limit a person’s ability to participate in the Contest.

 

ERRORS : The Contest Sponsor is not responsible for typographical or other errors in the offer or administration of the Contest, including, but not limited to, advertising errors, the Official Rules, the Contest Website, the selection and announcement of a winner, or errors related to the distribution of a Prize. In no event will the Contest Sponsor be liable for awarding more Prizes than indicated in these Official Rules (at any level). If, due to a printing, production, online, Internet, computer, or other error of any kind, a Prize notification incorrectly indicates the applicable Prize a participant is eligible to win, or erroneously declares a participant as a potential winner, that person will only receive the applicable Prize they are eligible to win according to the Contest Sponsor’s official data and records (as determined by the Contest Sponsor at its sole and absolute discretion).

 

RIGHT TO TERMINATE, MODIFY, OR SUSPEND : The Contest Sponsor may at any time, at its sole discretion and without liability, terminate, modify, or suspend the Contest in whole or in part, subject only to required legal approvals, if fraud, technical failures, communication errors, or other causes beyond the Contest Sponsor’s control corrupt the administration, integrity, or security of the Contest or if any other factor impairs the conduct of the Contest as intended by these Rules. Without limiting the generality of the foregoing, in the event of early termination of the Contest, a notice will be posted to that effect on the Contest Website. Furthermore, to determine eligibility to win a Prize in the event of early termination, all eligible entries received before the time of early termination will be considered valid and, for the purposes of these Official Rules, the Contest Period will be deemed to have ended at the time of early termination. No waiver by the Contest Sponsor of any provision herein will be deemed a continuing waiver or a waiver of any other provision.

 

DISQUALIFICATIONS : If the Contest Sponsor discovers (using evidence or any information provided or obtained by its own means) that a person has attempted to: (i) exceed the limits or restrictions specified in these Official Rules; (ii) use multiple names, identities, email addresses, accounts and/or automated or robotic systems, scripts, macros, or any other means or programs to enter or participate in the Contest or disrupt its operation; (iii) enter the Contest more times than allowed; (iv) submit an entry or enter a code or unique PIN (if applicable) that has been falsified, tampered with, or altered in any way; (v) disrupt the Contest or participate fraudulently or deceptively (including, but not limited to, canceling, changing, or modifying a transaction); or (vi) participate in the Contest in any other disruptive, abusive, fraudulent, deceptive, unfair, unsportsmanlike, or inconsistent manner with these Official Rules (as determined by the Contest Sponsor at its sole and absolute discretion); they may then be disqualified from the Contest, at the sole and absolute discretion of the Contest Sponsor. If a person is disqualified, they forfeit all rights to a Prize.

 

WARNING : ANY DELIBERATE ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO MODIFY OR DAMAGE ANY ENTRY OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS; SHOULD SUCH AN ATTEMPT OCCUR, THE CONTEST SPONSOR RESERVES THE RIGHT TO DISQUALIFY THAT PARTICIPANT OR INDIVIDUAL AND TO SEEK DAMAGES OR TAKE ANY OTHER REMEDY AGAINST THAT PARTICIPANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

PRIVACY POLICY : The Contest Sponsor respects your right to privacy. Personal information collected from participants will only be used by the Contest Sponsor to administer the Contest and fulfill the conditions of awarding the Prize and, only if consent is given at the time of entry, to provide participants with information about upcoming promotions or events of the Contest Sponsor. GOVERNING LAW : For consumers residing in Quebec, this Contest and the Official Rules are governed by Quebec law, and all participants expressly agree that the courts of Quebec have exclusive jurisdiction for any dispute or litigation arising from or relating to this Contest, and agree to submit to the jurisdiction of the courts of Quebec.

The invalidity or unenforceability of any provision of these Rules does not affect the validity or enforceability of any other provision. If any provision is found to be invalid, unenforceable, or illegal, these Rules will remain in effect and be interpreted in accordance with their terms as if the invalid or illegal provision were not included.

 

SUBJECT TO APPLICABLE LAWS : The Contest is subject to these complete Official Rules and all applicable federal, provincial, and local laws and regulations. By participating in the Contest, you acknowledge that you have read the Official Rules and agree to comply with its terms and the decisions of the Contest Sponsor, which are final and binding on all matters relating to the Contest. Questions, comments, or complaints regarding the Contest must be addressed to the Contest Sponsor. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.

 

LANGUAGE DISCREPANCIES : In the event of any discrepancy or inconsistency between the terms of these Official Rules and any disclosures or other statements contained in any Contest-related information or materials, including, but not limited to, point-of-sale, television, print, or online advertising, the terms of these Official Rules shall prevail, govern, and control.
