MICHELOB MONTREAL GRAND PRIX CONTEST (the “contest”)

 

OFFICIAL CONTEST RULES

IMPORTANT: PLEASE READ THESE OFFICIAL CONTEST RULES (“OFFICIAL RULES”) BEFORE ENTERING THE “MICHELOB MONTREAL GRAND PRIX CONTEST” (THE “CONTEST”). BY ENTERING THE CONTEST, EACH ENTRANT REPRESENTS THAT THEY MEET ALL OF THE ELIGIBILITY REQUIREMENTS BELOW AND AGREES TO BE UNCONDITIONALLY BOUND BY THESE OFFICIAL RULES AND ALL DECISIONS OF LABATT BREWERIES LIMITED (THE “CONTEST SPONSOR”). BY ENTERING, THE ENTRANT SHALL NOT HOLD THE CONTEST SPONSOR RESPONSIBLE FOR ANYTHING THAT MAY HAPPEN DURING THE CONTEST.

NO PURCHASE NECESSARY. You MUST be of legal drinking age. THE CONTEST IS OPEN TO QUEBEC RESIDENTS ONLY.

 

CONTEST PERIOD

The “MICHELOB MONTREAL GRAND PRIX CONTEST” Contest (hereinafter the “Contest”) is being held by Labatt Breweries Limited (the “Contest Organizer” and “Contest Sponsor”). The contest begins on or about May 5, 2023, at 8:00 a.m. Eastern Standard Time (EST) and ends on June 7, 2023, at 11:59 p.m. EST (the “Contest Closing Date”), after which no further entries will be accepted (the “Contest Period”). The Contest is being held at all participating locations.

 

HOW TO ENTER

To enter the contest, the consumer (hereinafter the “consumer") must purchase one selected Michelob Ultra product at a participating establishment. To be eligible, consumers must have Internet access and a valid email address on the date of their entry. The entrant must scan the QR code and complete the contest entry form in its entirety at the following web address: www.shopbeergear.ca/MUxWILLIAMSRACING  and provide the correct answer to the mathematical skill-testing question. Once all required fields are completed, click on the "Submit" button.

Limit one (1) entry per person during the Contest Period and limit one (1) prize per household. No other method of entry will be accepted. Any entrant attempting to enter with multiple accounts under multiple identities will be disqualified and will forfeit any prize won, at the sole discretion of the Contest Sponsor. If the identity of an entrant is disputed, the authorized account holder of the email address provided at the time of entry will be deemed to be the entrant. The person assigned to the email address by an online service provider, Internet access provider or other organization responsible for assigning the email address for the domain associated with the submitted email address is considered the authorized account holder. An entrant may be required to provide the Contest Sponsor with proof that they are the authorized account holder of the email address associated with the winning Entry.

For no purchase entry, Entries must be received by the Contest Closing Date. Entries received after the Contest Closing Date will not be eligible and will not be processed.

ELIGIBILITY

The Contest is open only to residents of Quebec who are of legal drinking age in their province of residence and who are not employees, officers, directors, contractors, agents or representatives of the Contest Sponsor, or their respective parent companies, their respective subsidiaries, affiliates, agencies, distribution companies, applicable provincial liquor authorities, participating liquor licensees, prize suppliers, the Contest judge or any person domiciled at the same address as any of the above. Provincial liquor authorities are not connected with this Contest in any way and are not in any way responsible for any matter relating to this Contest. DRAW

One (1) entrant will be selected at random by the Contest Sponsor or its designee (“Administrator") in Montreal, Quebec on or about June 8, 2023, 12:00 p.m. (EST) from among the eligible entries received during the Contest Period (as defined above). Entries will be stored in a Contest database and will be randomly selected in accordance with these Official Rules (the Contest database and the site on which these Official Rules are posted by the Contest Sponsor are collectively referred to as the “Contest Website”). The potential winner will be selected in accordance with these Official Rules.

 

PRIZE

There is one (1) prize to be won among all participating establishments. The prize consists of one (1) pair of tickets to attend the Montreal Grand Prix in the stands on June 16, 17 and 18, 2023. The value of the prize is approximately $2,400 CAD and the approximate total retail value of the prizes is $2,400 CAD. Labatt Breweries Limited is not responsible for the use or misuse of the prize once awarded. ALCOHOL IS NOT INCLUDED IN THE PRIZE.

Odds of winning the prize depend on the total number of eligible entries received during the Contest Period. The number of prizes available will decrease as prizes are won or claimed.

Prize must be accepted as awarded. Prize is not transferable or redeemable for cash. No prize substitutions, except by the Contest Sponsor, who reserves the right to substitute the prize or any portion thereof with a prize of equal or greater value. All decisions of the Contest Sponsor are final and not subject to appeal.

If the number of eligible entries received is less than the number of prizes to be awarded, only the eligible entries received will be drawn and the remaining prizes will not be awarded.

 

AWARDING OF PRIZES

The selected entrant will be notified by telephone by the Contest Sponsor or Contest Administrator within 72 hours of the draw.

The entrant must sign the Declaration and Release Form (the “Declaration Form”) that will be sent to them and return it to the Contest Sponsor no later than 72 hours after receiving it.

If the selected entrant has not contacted the Contest Sponsor or Contest Administrator within 72 hours of receiving the Declaration Form, they will receive another notification within 72 hours. If the selected entrant has not contacted the Contest Sponsor or Contest Administrator within 72 hours of receiving the first notification, another entrant may, at the sole discretion of the Contest Sponsor, be selected by random draw, in which case that entrant will become the selected entrant. The previously selected entrant will be disqualified and will not be entitled to any prizes.

Once the documents have been received, signed, and submitted to the Contest Sponsor, the winner can collect their prize at the store.

The Contest Sponsor makes no representations or warranties of any kind regarding the appearance, safety, or performance of any prize. The Contest Sponsor is not responsible for any prize once it has been awarded.

 

CONDITIONS AND DISCLAIMER

Before being declared a winner, the selected entrant must correctly answer, unaided, a mandatory mathematical skill-testing question which appears on the Entry Form. Before the prize is awarded, the winner may be required to sign a Declaration of Compliance with the Official Rules and one or more release forms releasing the Contest Sponsor (including its directors, officers, employees, agents and representatives), its parent companies, subsidiaries, professional advisors, provincial liquor authorities and its advertising and promotional agencies (collectively, the “Released Parties”) from any and all liability arising out of, under or in connection with the operation of the Contest, including, without limitation, liability arising from the acceptance and use of the Prizes as awarded, the administration of the Contest and the selection of a potential winner. By entering the Contest or accepting a prize, the entrant agrees to release and hold harmless the Released Parties from any and all causes of action, for any and all claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest, or in connection with the possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injury, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

 

GENERAL STATEMENTS

The Prize is non-exchangeable, non-transferable, non-refundable, has no cash surrender value and must be accepted as awarded, without substitution. The Contest Sponsor reserves the right, in its sole discretion, to substitute the Prize, or any portion thereof, with a prize or prizes of equal or greater value for any reason. The decisions of the Contest Sponsor are final, and each entrant agrees to abide by all instructions and decisions of the Contest Sponsor and/or Contest Administrator. In the event of any dispute regarding the interpretation of these Official Rules, the decision or interpretation of the Contest Sponsor and/or the Administrator shall prevail. No communication will be entered into except with the selected entrant(s). All entries become the property of the Contest Sponsor. Any entry that is illegible, incomplete, altered or contains false information is invalid. The Contest Sponsor is not responsible for any problems or technical malfunctions or any internet or telephone network or broadcast transmission during the Contest Period. The Contest Sponsor reserves the right to modify or terminate this Contest at any time without notice to entrants.

To receive the list of winners, mail a self-addressed stamped envelope to 50 Labatt Avenue, LaSalle, Quebec H8R 3E7. “MICHELOB MONTREAL GRAND PRIX CONTEST”. The list of winners will be sent once winners are confirmed.

 

LIMITATION OF LIABILITY

The Released Parties are not responsible for damages caused or claimed to be caused by: (i) any Entry, prize or other correspondence or data that is lost, stolen, late, garbled, delayed, damaged or misdirected for any reason; (ii) any failure, interruption, technical malfunction or delay (iii) any email, text message or other communication sent or received by the Contest Sponsor or any of its agents or delegates for any reason; (iv) any false, misdirected or inaccurate information, whether caused by the sites, users, or by equipment or programming errors associated with or utilized by the Contest (v) any technical or human error that may occur in the processing of one or more Contest entries; for problems with the operation of a website or website functionality, regardless of cause; (vi) malfunctions or damage to any telephone network or lines, computer equipment, data, software, online systems, servers, or access providers (vii) any lost functionality due to non-activation of cookies; (viii) traffic congestion on the Internet; (ix) the security or privacy of information transmitted over computer networks; (x) breaches of confidentiality due to interference by third-party “hackers” or for any damage caused or suffered by a participant or any other person as a result of any such event or occurrence; or (xi) technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, including lost, misdirected or corrupted entries, damage caused by viruses, worms or Trojan Horses, or any other damage that may limit an entrant's ability to participate in the Contest.

 

ERRORS

The Contest Sponsor is not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of a winner, or the distribution of any prize. The Contest Sponsor reserves the right to terminate the Contest or modify these Official Rules at any time, in its sole discretion and without prior notice to entrants, subject to the approval (if required) of the Régie des alcools, des courses et des jeux du Québec.

 

TERMINATION/MODIFICATION

Subject to applicable law, if the Contest cannot be run as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes of any nature whatsoever beyond the reasonable control of the Released Parties that corrupt or affect the administration, security or proper conduct of the Contest, the Contest Sponsor reserves the right, in its sole discretion and without notice, to terminate or suspend the Contest, in whole or in part, or to modify it in any way.

 

INTERPRETATION

Subject to applicable law and these Official Rules, this Contest and the Official Rules are governed by the laws of Quebec and all entrants expressly agree that the courts of Quebec shall have exclusive jurisdiction over any dispute or litigation arising from this Contest. The venue for any dispute or litigation shall be Montreal, Quebec. The venue for any dispute or litigation shall be Montreal, Quebec.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall remain in full force and effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

DISQUALIFICATIONS

The Contest Sponsor reserves the right, in its sole discretion, to disqualify any individual who (i) tampers with the entry process or the operation of the Contest; (ii) acts in violation of the Official Rules; or (iii) acts in a disloyal or disruptive manner, or with intent to hinder, abuse, threaten or harass any other person, or to post inappropriate or degrading material on the web page. WARNING: ANY DELIBERATE ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE OR ALTER ANY ENTRY OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS; IF SUCH AN ATTEMPT SHOULD BE MADE, THE CONTEST SPONSOR RESERVES THE RIGHT TO DISQUALIFY SUCH ENTRANT OR INDIVIDUAL AND SEEK DAMAGES OR OTHER RELIEF AGAINST SUCH ENTRANT OR INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

 

DISPUTES

QUEBEC RESIDENTS: ANY LITIGATION RESPECTING THE CONDUCT OR ORGANIZATION OF A PUBLICITY CONTEST MAY BE SUBMITTED TO THE RÉGIE DES ALCOOLS, DES COURSES ET DES JEUX FOR A RULING. ANY LITIGATION RESPECTING THE AWARDING OF A PRIZE MAY BE SUBMITTED TO THE RÉGIE FOR THE SOLE PURPOSE OF HELPING THE PARTIES REACH A SETTLEMENT. ANY DECISION MADE BY THE CONTEST SPONSOR THAT AFFECTS THE OPERATION OF THE CONTEST IS SUBJECT TO THE APPROVAL OF THE RÉGIE DES ALCOOLS, DES COURSES ET DES JEUX.

 

PRIVACY

The Contest Sponsor respects your right to privacy. Personal information collected from entrants will only be used by the Contest Sponsor to administer the Contest and fulfill the prize requirements and, only if consent is given at the time of entry, to provide entrants with information about upcoming promotions and/or events of the Contest Sponsor. SUBJECT TO APPLICABLE LAWS

The Contest is subject to these complete Official Rules and all applicable federal, provincial and local laws and regulations. By entering the Contest, you acknowledge that you have read the Official Rules and agree to abide by their terms and the decisions of the Contest Sponsor, which are final and binding in all matters relating to the Contest.
