2021 KOKANEE SKI TICKET PROGRAM - OFFICIAL RULES AND REGULATIONS

IMPORTANT:  PLEASE READ THESE OFFICIAL RULES AND REGULATIONS ("RULES") BEFORE ENTERING THE SKI TICKET SWEEPSTAKES (“THE CONTEST”). BY ENTERING THE CONTEST, AN ENTRANT REPRESENTS THAT HE OR SHE SATISFIES ALL OF THE ELIGIBILITY REQUIREMENTS BELOW AND AGREES TO BE BOUND UNCONDITIONALLY BY THESE OFFICIAL RULES AND ALL DECISIONS OF LABATT BREWING COMPANY LIMITED. 

NO PURCHASE NECESSARY TO PARTICIPATE. MUST BE OF LEGAL DRINKING AGE. OPEN TO RESIDENTS OF THE PROVINCE OF ALBERTA, BRITISH COLUMBIA, MANITOBA, AND SASKATCHEWAN ONLY.

 

1. SPONSOR:  This Contest is sponsored by Labatt Brewing Company Limited (the “Contest Sponsor”). 

 

2. ELIGIBILITY: The Contest is open to legal residents of British Columbia, Alberta, Saskatchewan or Manitoba who are legal drinking age in their province of residence, who is not an employee, officer, director, contractor, agent or representative of the Contest Sponsor, Fernie Alpine Resort, Nakiska Ski Area, Kicking Horse Mountain Resort, Kimberley Alpine Resort, Whistler Blackcomb, The Lake Louise Ski Resort, or Marmot Basin, (collectively the “Contest Parties”), or a member of the immediate family (parent, spouse, sibling, child) of, or domiciled with any of the foregoing persons, and who is not an employee of the applicable provincial liquor agencies, license control/boards and their licensees, retailers, or distributors (the “Provincial Liquor Authorities”). The Provincial Liquor Authorities and the Contest Parties are not and shall not be liable in any way whatsoever in regard to any matter which relates to this Contest or any prize awarded. This Contest is in no way sponsored, endorsed or administered by, or associated with the Provincial Liquor Authorities, or the Contest Parties. 

 

To be eligible, participants must have online access with a valid email address as of the date of their entry. Each unique PIN can only be entered once. A maximum of two (2) valid PIN codes may be entered per person per calendar day. A “day” is defined as a twenty-four (24) hour time period between 12:00 am PT and 11:59:59 pm PT of the same day, except for the first day of the Contest which shall begin at 12:00:00 pm PT and end at 11:59:59 p.m. PT of the same day. In the event of a dispute as to the identity of the entrant who submitted a valid PIN, the authorized account holder of the email address submitted at the time of entry will be deemed to be the entrant.  The “Authorized Account Holder” is the natural person assigned to the email address by an online service provider, Internet access provider or other organization responsible for assigning the email address for the domain associated with the submitted email address. An entrant may be required to provide the Contest Sponsors with proof that she or he is the authorized account holder of the email address associated with the winning entry. 

 

If you participate via a mobile device, you may incur standard data charges from your wireless service provider. Check with your wireless service provider for details on these and other applicable charges. Entrants are solely responsible for any such data charges. If you do not have Internet access via a personal computer, your local library or Internet café may be able to provide access to the Internet and a number of Internet service providers and other companies offer free email accounts. 

 

 3. CONTEST PERIOD: The Contest starts on November 1, 2022, at 12:00:00 pm (noon) PT, and the Contest closes on March 1, 2022, at 11:59:59 pm PT.  

4. PARTICIPATING PRODUCTS: During the Contest Period, consumers can look inside specially-marked 24-can packs of Kokanee for a Kokanee PIN code (“PIN”). Specially-marked cases are only available while supplies last. 

5. HOW TO PLAY: During the contest period, find a unique PIN inside specially marked packs of Kokanee or obtain one through no purchase necessary entry (see NO PURCHASE NECESSARY below for details). Go to http://www.kokanee.ca/  and follow the instructions to enter the unique PIN for your chance to ‘instantly’ win a prize (see PRIZES below for details).  Once the PIN has been entered, you will be required to complete a contest entry form in full by providing [First Name, Last Name, Email Address], and the correct answer to a skill-testing question. Participants must check boxes on the entrance form to confirm they are of legal drinking age in their province of residence, a resident of British Columbia, Alberta, Saskatchewan, or Manitoba, agree to the pin program terms and conditions, and agree to the terms of service and acknowledge that they have read and understood the privacy policy. Once all fields have been completed, click submit and you will immediately see a message that will confirm whether or not you are an ‘instant’ winner.  

If you are not a winner, you will receive the following notice, “Thank you for participating! You’re unfortunately not one of the winners at this time”.  

If you are confirmed as a potential winner, you will be automatically taken to a digital shopping cart where you can choose from 1 of 7 prizes. Regional travel restrictions may apply. Please consult local, provincial and federal guidelines for travel restrictions related to COVID-19 prior to selecting your preferred lift ticket.  

After selecting a prize from the digital shopping cart and clicking “Claim My Prize, you will be taken to check out. Complete the checkout steps by inputting the following information: [Email, First Name, Last Name, Address (No PO boxes)]. Once check out is complete you will receive a confirmation email containing your digital prize code with instructions on how to redeem.  Prize will be emailed only after the checkout steps are completed and confirmed.   

Entrants must complete the contest form in its entirety, including providing the correct answer to the skill-testing question, and be in compliance with these Rules to be eligible to win. Entries must be received prior to the Contest Close Date. Entries received after the Contest Close Date are void. 

6. NO PURCHASE NECESSARY: To receive a PIN without purchase while supplies last, please send a written request to Kokanee – Ski Ticket Sweepstakes, 700 58 Ave SE, Calgary AB, T2H 2E2. All requests must include an approximately one hundred (100)-word original handwritten essay answering the question “Why is skiing or snowboarding important to you?” along with sender’s name, return mailing address, the statement “I am legal drinking age or older in my province of residence” and your signature. You must also enclose a self-addressed, stamped 11 x 15” envelope. Limit one (1) request per household. Requests must be received in time so that a PIN can be mailed to you in time to participate before the Contest Close Date. While Supplies Last.   

PRIZES: Once a participant has been verified as an Instant Win Prize winner, they will be able to choose one of the prizes listed in the chart below. The Contest Sponsor is not liable if travel is impeded or refused by reason or decisions of any governmental authorities (federal or provincial) or regional health authorities.  Regional travel restrictions may apply. Please consult local, provincial and federal guidelines for travel restrictions related to COVID-19 prior to booking or participating in travel experiences. 

There are seven (7) different Instant Win Prizes available to choose from during the Contest Period (each, an “Instant Win Prize”, as provided in the table below). If there is no longer any inventory of the prize which an Instant Win Prize winner has selected, they will be required to make an alternative selection or forego their prize entirely. Approximate retail value of each prize is stated in Canadian dollars. 

 

The number of prizes available to be won will diminish as they are claimed throughout the Contest Period. The total number of prizes available to be won is five thousand (5,000). Once the total number of prizes have been distributed, no further prizes will be available. Once selected, prizes must be accepted as awarded. Prizes are non-transferable and non-redeemable for cash. No substitutions, except by the Contest Sponsors, who reserve the right to substitute a prize with a prize of equal or greater value. Awarding of a prize is subject to verification and compliance with the Rules.  Entrants who have not complied with the Rules will be disqualified. The Contest Sponsors make no representations or warranties of any kind concerning the appearance, safety or performance of any prize. The Contest Sponsors are not responsible for any Prize once it has been shipped. Any unclaimed prize will not be awarded. Once check out is complete you will receive a confirmation email containing your digital prize code with instructions on how to redeem.  Prize will be emailed only after the checkout steps are completed and confirmed. The odds of winning are 1 in 17.

7. RELEASE: By participating in this Contest, all participants declare that they have read, understood and complied with the Rules, and for winners, consent to the use of their name, biographical information and/or likeness for the purposes of advertising and promotion without further compensation, agree to abide by all decisions by the Contest Sponsors (which are final), and agree to release, indemnify and hold harmless the Contest Parties, and each of their affiliates, directors, officers, employees, professional advisors and advertising and promotional agencies (collectively, the “Released Parties”) from any liability in connection with participating in this Contest and/or any prize awarded. The Released Parties are not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions including lost, misappropriated or corrupted entries, virus, worm or Trojan Horse damage or any other damage which may limit a participant's ability to participate in the Contest. Before a prize is awarded, prize winners may be required to sign a standard declaration of compliance with the Rules and release form(s) in a form acceptable to the Provincial Liquor Authorities releasing the Released Parties from any and all liability arising out of, pursuant to, or as a result of the carrying out of the Contest, including, without limitation, liability arising from the acceptance of and usage of the prizes as awarded, the administration of the Contest and the selection of a potential winner. 

 

8. GENERAL: PINs obtained through unauthorized sources or which are not original or are illegible, altered, reproduced, stolen, forged, counterfeited, irregular, or that contain printing or other errors are void. All decisions of the Contest Sponsors shall be final. The Contest Sponsors are not responsible for errors in the offer or administration of this Contest, including but not limited to, errors in the advertising, the Contest Rules, selection of the winners or the distribution of any prize. In the event that, due to an error, more than the advertised number of prizes are claimed, no more than the number of prizes specified in these Rules shall be awarded. The Contest is subject to all applicable federal, provincial, municipal and local laws. The Contest Sponsors reserve the right to modify or terminate this Contest at any time without notice to participants. 

 

9. PRIVACY: The Contest Sponsors respect your right to privacy. Personal information collected from entrants will only be used by the Contest Sponsors to administer the Contest and fulfill any prize requirements and, only if consent is given at the time of entry, to provide the entrants with information regarding upcoming promotions and/or events from the Contest Sponsors. 10. DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to conflicts of law principles.  All entrants consent to the jurisdiction and venue of the Province of Ontario. 

 

11. CONFLICTS/DISCREPANCIES: In the event of a conflict between any Contest details contained in these Rules and any Contest details contained in Contest advertising materials (including, but not limited to, online, point of sale, television, and print advertising, promotional packaging, and other promotion media), the details of the Contest as set forth in these Rules shall prevail. 

 

12. INVALIDITY: The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
